Negligent design leading to loss and expense claims by the contractor

 

We were asked to act for a multi-national company against its project managers and designers of a landfill site on the basis that the design was negligent leading to loss and expense claims by the contractor which the project managers, who were geotechnical experts, ought to compensate.

Also claiming that they, the geotechnical experts and project managers, had been incompetent in their financial management of the NEC construction contract leading to a substantial overspend.

The outcome:

The matter was prepared for litigation but it was settled at a mediation for a sum in excess of the amount that the client had been prepared to accept at the outset.

Summary Judgement Proceedings 

We were asked to act for an aggregates company against its earthworks contractor engaged under an NEC contract to build a landfill site from a former clay pit.

The outcome:

The contractor was found by the project manager to have been overpaid and summary judgment proceedings secured a payback settlement including some cash and some discounting of future work to be awarded to the contractor.
