Search Orders

We were asked to act for a firm of solicitors outside their jurisdiction, who had obtained a search order against a defendant living in England. We advised that it would be necessary to obtain a search order from the Senior Court in London in aid of the existing search order.

 

The strategy:

We arranged to make the application with supporting evidence as a matter of extreme urgency, liaising with the supervising solicitor and subsequently attending the defendant’s home to execute the search and to identify and remove relevant documents and devices, on which electronic information might be stored. Acting with the assistance of a forensic computer expert.


The outcome:

Subsequently attending court to secure the continuation of the order pending the outcome of the proceedings in the foreign jurisdiction.

Breach of Terms of Employment


Acting for a client whose employee had been discovered soliciting business from existing customers for his own company in breach of his terms of employment.

 

The employee was believed to be in possession of computer records of customers, pricing and job specifications. We obtained a search order and, accompanied by a forensic computer expert, attended the employee’s home address, in order to execute the order, and to remove relevant documents and computer hard drives.
