Negligent Asbestos Surveyors
Acting for a retailer with branches throughout the United Kingdom in a claim against a firm of asbestos surveyors who had carried out asbestos surveys at over 500 branches but who had negligently failed to discover and report the location of asbestos within the premises.
The case involved collating extensive evidence in the form of original survey reports and survey reports carried out by an alternative surveyor. It was necessary to instruct an independent asbestos expert to compare the survey reports and to provide expert opinion as to the seriousness of the instances of missed asbestos.
The case involved the extensive investigation of the client’s historic records relating to the management of asbestos in its branches.
A mediation was held prior to the issue of proceedings in the hope that the matter could be settled but was unsuccessful. Proceedings were issued in the Technology and Construction Court and eventually a settlement was negotiated enabling the client to recover substantial damages.
